Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the https://www.eddiecockramart.com website (the “Service”) operated by EddieCockramArt (“us”, “we”, or “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Who we are?

https://www.eddiecockramart.com is the official website for UK based artist, Eddie Cockram. Eddie died in March 2023, and the website was established as a celebration of his life’s artwork by his daughter Alison Dawson and her husband Ian Dawson (the “owners”).
The trading name EddieCockramArt and website are registered with, and owned by, the owners. The registered trading address is: EddieCockramArt, 4 Queens Head Cottages, Whielden Gate, Amersham, Bucks, HP7 0NE.

Conditions of Sale

1 Definitions
In these conditions, unless the context requires otherwise:
1.1 ‘Buyer’ means the person who buys or agrees to buy the goods from the Seller;
1.2 ‘Conditions’ means the terms and conditions of sale set out in this document and any special terms and conditions agreed in writing by the Seller;
1.3 ‘Goods’ means the original artwork and/or prints, as specified on the website or otherwise agreed in writing by the Seller as a bespoke Service, which the Buyer has ordered and agrees to buy from the Seller;
1.5 ‘Price’ means the price for the Goods including UK carriage and packing as specified in the website price list, or otherwise agreed in writing by the Seller as a bespoke Service price; and
1.6 ‘Seller’ means the owners, as specified in the ‘Who are we’ section herein.
2 Conditions applicable
2.1 All orders for Goods shall be deemed to be an offer by the Buyer to purchase Goods pursuant to these Conditions and such orders shall be deemed conclusive evidence of the Buyer’s acceptance of these Conditions.
2.3 Any variation to these Conditions (including any special terms and conditions agreed between the parties) shall be inapplicable unless agreed in writing by the Seller.
3 Price and payment
3.1 The Price shall be the price set out in the website, or otherwise agreed in writing between the Seller and the Buyer for bespoke Services.
4 Returns policy
We are confident that you will not want to return EddieCockramArt artwork, but if you do, you have the right to cancel the purchase of Goods without giving a reason at any time within the ‘cooling off period’ of fourteen days beginning on the day after receipt of the Goods.
If you are in possession of the Goods you are under the duty to retain them and take reasonable care of them. You must send the Goods back to the Seller at the address provided at your own cost (unless we sent them in error, or the Goods are damaged/defective), using the original packaging, wherever possible, in order to protect the integrity of the Goods.
A full refund will be made for returned original artwork Goods, once in receipt of the Seller and undamaged. A fifty percent (50%) refund will be made for returned printed artwork Goods, allowing for the direct costs of production of the printed Goods, and once in receipt of the Seller and undamaged.
Please allow up to 7 working days for such refund to be processed.
The Seller reserves the right to charge for the direct costs of recovering Goods if they are not returned (following instruction by the Buyer) or the Goods are returned at the Seller’s expense.
You will unfortunately not have the right to cancel a purchase, or to return Goods associated with bespoke Goods/Services.
5 Copyright
The Seller warrants to the Buyer that the Seller is the owner of the copyright of the artwork from which the Goods are produced.
The Buyer is not authorised by the copyright owner to reproduce, print and distribute the artwork Goods.
6 Governing Law
These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

Purchases

You are encouraged to familiarise yourself with your rights contained within the Sale of Goods Act 1979, Unfair Contract Terms Act 1977 and the Unfair Terms in Consumer Contracts Regulations 1999.
If you wish to purchase any Goods or service made available through the Service (“Purchase”), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.
You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete. You expressly agree that EddieCockramArt is not responsible for any loss or damage arising from the submission of false or inaccurate information.
By submitting such information, you grant us the right to provide the information to third parties for purposes of facilitating the production of Purchases.
We reserve the right to refuse or cancel your order at any time for certain reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order or other reasons. You expressly agree that EddieCockramArt cannot accept any liability for loss or damage arising out of such cancellation.
We reserve the right to refuse or cancel your order if fraud or an unauthorised or illegal transaction is suspected.

Availability, Errors and Inaccuracies

We are constantly updating our offerings of products and services on the Service. The products or services available on our Service may be mispriced, described inaccurately, or unavailable, and we may experience delays in updating information on the Service. You expressly agree that any such offer of a product or service does not constitute a legal offer capable of attracting legal consequences.
We cannot and do not guarantee the accuracy or completeness of any information, including prices, product images, specifications, availability, and services. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice. Section “Availability, Errors and Inaccuracies” is without prejudice to existing statutory rights.

Accounts

When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.
You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
Intellectual Property
The Service and its original content, features and functionality are and will remain the exclusive property of EddieCockramArt. The Service is protected by copyright, trademark, and other laws of both the United Kingdom and foreign countries. Our trademarks and trade address may not be used in connection with any product or service without the prior written consent of EddieCockramArt.
